Terms of Use

These Terms of Use ('Terms') govern your access to and use of the Fond mobile application and any related services (together, 'Fond'). Fond is provided by Ebubekir DEMİRAY ('we', 'us', or 'the provider'). By downloading, installing, or using Fond, you confirm that you have read, understood, and agreed to these Terms in full.

If you do not agree with any part of these Terms, please do not download or use the app. We have tried to keep this document clear and readable, but it remains a legal agreement between you and the provider.

Fond is a shared voice-journaling app for couples and families. You can record one short voice note each day, keep your memories in private shared spaces called 'jars', and invite the people you choose to join a jar with a short code.

A core part of the experience is the asymmetric reveal: you cannot listen to another member's note for a given day until you have recorded your own for that day. Over time, Fond can also weave your notes into gentle weekly and monthly summaries.

The Fond application, including its name, logo, design, text, graphics, and underlying software, is owned by the provider and is protected by copyright and other intellectual property laws. You may not copy, modify, reverse-engineer, distribute, sell, or create derivative works from any part of Fond without prior written permission.

The memories you create — your recordings and the notes within your jars — remain yours, as described in the section on your content below.

You retain ownership of the voice notes and memories you create in Fond. We do not claim ownership of your content. You are solely responsible for what you record, for the jars you create, and for the people you invite into them.

You agree to use Fond only for your own personal, non-commercial memories, and to invite only people who are happy to take part. You must not use Fond to record or share content that you do not have the right to share, that is unlawful, or that harasses, threatens, or harms anyone. Where a recording includes other people, you are responsible for having their consent to record and share it.

Fond offers an optional Premium subscription that unlocks additional features. Premium is offered as an auto-renewing subscription, and all purchases, renewals, and billing are handled by Apple through your App Store account, subject to Apple's terms.

Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your App Store account settings. We do not process or store your payment details.

You are responsible for keeping your device secure and for any activity that happens through your installation of Fond. You should keep your device charged and your operating system up to date so the app can work as intended.

We strongly advise against using Fond on a jailbroken or rooted device. Doing so can compromise the security of your device and the protections built into Fond, may stop the app from working correctly, and is done entirely at your own risk.

Fond relies on a small number of third-party services to operate — for example, analytics and diagnostics providers that help us understand how the app is used and fix problems, and Apple's App Store for distributing the app and handling subscriptions.

These third parties have their own terms and privacy policies, which govern your use of their services. We choose our providers carefully, but we do not control them and are not responsible for their practices.

Fond needs an active internet connection to sync the text of your notes between members of a jar and to create summaries. Some features may not work, or may not work correctly, when you are offline.

The provider is not responsible for the cost of your internet access. If you use Fond outside a Wi-Fi network, your mobile carrier's data charges may apply, including roaming charges while you are travelling. If you are not the bill-payer for the device, we assume you have permission from the bill-payer to use the app.

We work to keep Fond available and reliable, but we provide the app on an 'AS IS' and 'as available' basis. We may add, change, suspend, or remove features at any time, and we may need to release updates that you must install for the app to keep working.

We do not guarantee that Fond will always be available, uninterrupted, or error-free, and we are not liable for any loss arising from reliance on information shown in the app or from the app being unavailable.

You may stop using Fond at any time by deleting your content from within the app and uninstalling it from your device. We may suspend or end your access to Fond if you breach these Terms or use the app in a way that could harm other people or the service.

When access ends, your right to use the app stops immediately.

We may update these Terms from time to time as the app evolves or as the law requires. When we do, we will post the updated version on this page and change the 'last updated' date above. We encourage you to review this page from time to time. Continuing to use Fond after changes take effect means you accept the updated Terms.
